Gary, who lives in a high risk wildfire area, collects natural rain water (yes, from the sky) and the snow runoff (yes, snow from the sky) that falls on his property. He has managed to fill 3 reservoirs (aka man made ponds) on his property that he can not only use to protect his home from fires, but for recreational purposes such as fishing and boating.
The Medford Water Commission, however feels differently. They say the water is tributary of a nearby creek, which gives the Commission full ownership – or so they say – and the court agreed.
When asked about his jail sentence, Gary told the AP “When it comes to the point where a rural landowner can’t catch rainwater that falls on his land to protect his property, it’s gone too far. This should serve as a dire warning to all pond owners.”
“The government is bullying. They’ve just gotten to be big bullies and if you just lay over and die and give up, that just makes them bigger bullies. So, we as Americans, we need to stand on our constitutional rights, on our rights as citizens and hang tough” he adds.
